This Privacy Policy applies only to the websites controlled by FemmePharma Holding Companies its affiliates and subsidiaries (collectively, the “Company”) where this privacy policy is posted or referenced (collectively, the “Sites”). This Privacy Policy does not pertain to other information that is collected offline or to information that is posted or provided by third parties. This Privacy Policy is designed to help you understand how we collect, use and safeguard the information you provide to us and to assist you in making informed decisions when using the Sites.

This Privacy Policy is incorporated into and governed by the terms and conditions set forth in the Company’s Terms of Use.

For purposes of this Agreement, “Site” refers to the Company’s website, which can be accessed at femmepharma.com. The terms “we,” “us,” and “our” refer to the Company. “You” refers to you, as a user of the Sites.

  1. INFORMATION WE COLLECT
    This Privacy Policy applies only to information collected on the Sites and does not apply to information collected by the Company through any other means. We collect two types of information from visitors to the Sites: “Non-Personal Information” and “Personal Information.” Non-Personal Information includes information that cannot be used to personally identify you, such as anonymous usage data, general demographic information we may collect, referring/exit pages and URLs, platform types, preferences you submit and preferences that are generated based on the data you submit and number of clicks. Personal Information is information that identifies you personally, such as your name, address, telephone number, email address, or company name, which you submit to us through the Site.

    1. Non-Personal Information
      Here are some of the examples of the Non-Personal Information that may be collected through the Sites:

      • Internet Protocol (IP) Address – Your IP address is a number that lets computers attached to the Internet know where to send you date – such as the webpages you view.
      • Cookie – A “cookie” is a small text file that may be used to collect information about your activity on the Sites.     2. Personal Information
      We collect and store Personal Information that you have provided to use on the Sites, including but not limited to the following:

      • We may collect your first and last name, copies of your correspondence (including email addresses) and product details if you contact us with a question related to our products;
      • We may collect information that you provide by filling in forms on the Sites. This includes information provided at the time of registering to use the Sites or subscribing to e-mails. We may also ask you for information when you report a problem with the Sites.
      • We may collect your first and last name, mailing address and billing information if you purchase a product on one or more of the Sites, as applicable;
      • We may collect details of transactions you carry out through one or more of the Sites and of the fulfillment of your orders, applicable. You may be required to provide financial information before placing an order through the Sites;
      • We may collect your responses to surveys that we might ask you to complete for research purposes; and/or
      • We may collect your search queries on the Sites.

    3. Information you provide us by registering for an account
      To become a subscriber to the Sites you will need to create a personal profile. You can create a profile by registering with the Sites and entering your email address, and creating a user name and a password. By registering, you are authorizing us to collect, store and use your email address in accordance with this Privacy Policy.
    4. Children’s Privacy
      The Sites are not directed to anyone under the age of 13. The Site does not knowingly collect or solicit information from anyone under the age of 13, or allow anyone under the age of 13 to register with the Sites. In the event that we learn that we have gathered personal information from anyone under the age of 13 without the consent of a parent or guardian, we will delete that information as soon as possible.   2. HOW WE USE AND SHARE INFORMATION
    1. Personal Information:
      Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent or otherwise share for marketing purposes your Personal Information with third parties without your consent. We may share or disclose your Personal Information including but not limited to the following instances:

      • To our subsidiaries and affiliates in order to better serve you. The Company may have to share your Personal Information with these parties in order to provide you with services that have been requested by you, or so that we can ensure our services and products are meeting your needs.
      • To unaffiliated third-party service providers, agents, or independent contractors (vendors) who are performing services for the Company and who help us maintain the Sites and provide other administrative services to us.       • To protect against potential fraud, we may verify with third parties the information collected from the Sites. In the course of such verification, we may receive Personal Information about you from such services. Particularly, if you use a credit card or debit card to purchase services with us, we may use card authorization and fraud screening services to verify that your card has not been reported lost or stolen.

      In the event we undergo a business transaction such as a merger, acquisition by another company, or sale of all or a portion of our assets, your Personal Information may be among the assets transferred.     2. Non-Personal Information
      In general, we use Non-Personal Information in the same manner as Personal Information. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers and other third parties at our discretion.
  3. HOW WE PROTECT INFORMATION
    No data transmissions over the Internet can guaranteed to be 100% secure. We cannot ensure or warrant the security of any information you transmit to us and you understand that any information that you transfer to the Company is done at your own risk.We implement security measures designed to protect your information from unauthorized access. Your account is protected by your account password and we urge you to take steps to keep your personal information safe by not disclosing your password and by logging out of your account after each use. We further protect your information from potential security breaches by implementing certain technological security measures including encryption, firewalls and secure socket layer technology.     From time to time, we communicate with users who subscribe to our Sites via email. Therefore, this Privacy Policy does not apply to your use of a third party website accessed by selecting a link on our Sites. To the extent that you access or use the Sites through or on another website or application, then the privacy policy of that other website or application will apply to your access or use of that site or application. We encourage our users to read the privacy statements of other websites before proceeding to use them.

    The Company reserves the right to change this policy and our Terms of Use at any time in our sole discretion. We will notify you of significant changes to our Privacy Policy by sending a notice to the primary email address specified in your account or by placing a prominent notice on our site.
